Yes there are accidents, only thing is, is that us people cause them. The definition for accident is this; people cause accidents and accidents are an unplanned event. So with this said the shopping event should be re - evaluated. I feel for the widower very much because a lost life can never ever be replaced. I also agree that the cashier should have been well trained on how to bag merchandise. On the other hand the customer should have some intelligence as to the weight in which is being lifted from what is inside of the bag. If the bag feels over weight to the customer when lifted, then the customer should request a second or third bag for their safety. This case is kind of a draw. I understand the widowers loss, however the way I am viewing this case, is I feel both parties lacked good old common sense. Both the cashier and the customer probably knew that the bag was over loaded in weight, however because we are in a hurried up society both lacked good judgment and was to lazy to do what would have been the right solution in this case, so in my opinion both parties are at fault for the unfortunate accident. This is my conclusion and findings. I am sorry for the widowers loss, but I do not see where this case warrants a law suit. This is my opinion. Thank you. Greg.
