Yesterday, 2 1/2 years after the beginning of Occupy Denver, one of our own, Darren OConnor attended a bill signing at the Capitol for his work with Colorado Foreclosure Resistance Coalition. For three years Rep. Beth McCann has worked to try and improve the very unfair state of our foreclosure law that is weighted entirely towards the banks favor with the public trustee and Rule 120 Hearing system. Darren and Rep. McCann, the latter in pink, are standing on Governor Hickenloopers left side in the picture. Rep McCann was able to pass HB1295 after CFRC and Occupy Denver members effectively challenged Williams for her no vote against McCanns much stronger HB13-1249 of last year; Rep. Williams was highly motivated to show support for this bill to show that she is not oblivious to the needs of her constituents and Coloradans. However, this bill wasnt the bill McCann wanted; it wasnt the bill homeowners in Colorado needed; it is a bill the banking lobby (as represented by Jenifer Waller) and powerful foreclosure attorneys (Lawrence Castle and Cindy Lowery-Graber) allowed. We can only hope it meets the Hippocratic oath in that this is not the end of McCann and others recognizing the need to roll back the Draconian impacts of Lawrence Castles HB06-1387. We want to thank all who participated for three years to achieve what was possible with HB1295, recognizing and honoring that this small step was possibly the best that could be achieved. You worked a long time and the comments and concerns should not take away from your having accomplished this year at least something that may help homeowners. We will all watch now and see how judges and trustees incorporate these new, supposed requirements by banks and servicers to behave themselves.
