Since only 43 cars are entered, all drivers will make the race. • Latest on Tony Stewart: Accident investigation expected to take at least 2 more weeks: The Ontario County Sheriff issued the following statement Tuesday afternoon: The investigation into the death of Kevin Ward, Jr., of Lewis County, N.Y., is ongoing and is expected to continue for at least another two weeks or more. Investigators continue to seek witnesses, gather evidence, and develop the racetrack crash reconstruction. However, it would be inappropriate to discuss details or findings of the investigation with the media at this time. I would like to thank everyone for their cooperation as the Ontario County Office of Sheriff continues this investigation and for having patience as we conduct a thorough review of all of the relevant facts involving this tragic accident. When the investigation is completed, we will meet with members of the Ontario County District Attorneys Office and discuss with them all aspects of the investigation into the crash that occurred on August 9, 2014 at the Canandaigua Speedway. At that time, more information relating to any determinations that have been made may be released. In closing, on behalf of the Ontario County Office of Sheriff, our thoughts and prayers continue to be with the family of Kevin Ward, Jr. AND Stewart could still face legal consequences: [Stewart] could be charged with second-degree manslaughter under New York law if prosecutors believe he recklessly caused the death of another person, with negligent homicide another possibility, according to criminal law professor Corey Rayburn Yung of the Kansas University School of Law. Athletes in competition often do things that would get the average person arrested - think two boxers in the ring, or a baserunner sliding into second with his spikes high. But sometimes an act is so far outside the bounds of accepted sporting behavior that it becomes a crime, as former major leaguer Jose Offerman learned when he was charged with felony assault for rushing the mound - swinging a bat - after he was hit by a pitch in a minor league game. So Stewart would not expect to be charged for the car-on-car bump that sent Ward spinning into the wall. But if, for example, he were to tell police that he saw Ward on the track and tried to shower him with dirt or otherwise send him a message, a first-degree manslaughter charge could be a possibility, Yung said. Even if he is cleared by prosecutors, though, Stewart could face a civil suit. Although the standard of proof is lower than in a criminal case, the civil court would also consider Wards state of mind at the time of the accident and whether he was also negligent in venturing into racing traffic on a dark track in a dark suit. The rating was the highest for the race since a 3.2 in 2010. Indianapolis was the nations highest-rated metered market for the race telecast with a 9.6 rating, followed by Greenville/Spartanburg/Asheville at 9.5 and Greensboro/High Point/Winston-Salem at 9.1. When NASCAR officials hold their weekly competition meeting Tuesday, its likely they will discuss the circumstances that allowed Ward to exit his cockpit and angrily scramble down the banking to confront Stewart under a yellow flag at Canandaigua Motorsports Park. Wards death has prompted suggestions that rules are needed that keep drivers in their cars under caution until safety personnel arrive. At least two dirt tracks in New York made changes Monday as Brewerton Speedway and Fulton Speedway announced in a website release that drivers would be required to stay in their cars during an accident. If a driver were to exit the car during a yellow, the race would be placed under a red flag, and the penalty could include a fine or suspension. There is precedent for deaths in other series being the impetus for immediate changes in NASCAR. We always have discussions to become better, NASCAR spokesman Kerry Tharp told USA TODAY Sports. On Sunday at Watkins Glen, Busch reaffirmed his desire to give it a second shot. The Outlaw finished third in the NASCAR Sprint Cup Series race at Watkins Glen, establishing momentum for his second-consecutive Chase berth. While focused on the remainder of the season and his attempt to win a second Sprint Cup championship, Busch made no secret of his desire to return to Indianapolis next May. Six-year-old Luke Benners face appears on the #60 as part of the Nationwide Childrens Hospital Patient Champion program. On New Years Eve 2012, Benners parents noticed that his Lymph Nodes were very large and bulging from his neck. An emergency room trip, a doctors visit and an antibiotic did not show any improvement, so blood work was completed. Based on the results, Benner was immediately sent to Nationwide Childrens Hospital for evaluation where further analysis showed that he had Acute Lymphoblastic Leukemia. Benner quickly began chemotherapy treatments, including a schedule that would average an every other day visit to Nationwide Childrens Hospital for six to eight months, with a full treatment term of up to three-and-a-half years. The Mount Gilead, Ohio native has not skipped a beat since his diagnosis. Five-year-old Blake Hames, of Westerville, OH, will have his face on the hood and his name on the passenger side door of the #6 Ford as part of Nationwide Childrens Hospital Patient Champion Program. At 10 months old, Hames parents discovered a lump on his neck that was ultimately determined to be neuroblastoma, a rare type of cancer that affects the central nervous system. Given the size of the tumor and the risk of giving anesthesia to Hames at such a young age, doctors concluded that the best course of action would be to use chemotherapy to shrink the tumor. After several rounds of chemo, the tumor shrank down to a size that allowed it to be operated on. Despite the fact that surgery can now be completed, Hames family faced another issue as the tumor was located on the young childs vocal cords and that the pending surgery would render Hames unable to speak. With his parents relying on faith and months of prayer, Hames was released from the Nationwide Childrens Hospital cancer free. Within a year of leaving the hospital, Hames was able to do what was previously thought would not be possible, speak. Instead of giving up on his lifelong dream, Reed found a doctor that believed he could continue racing and took the necessary steps to do so. This weekend for the Nationwide Childrens Hospital 200 at Mid-Ohio Sports Car Course, Reed is paired with Dalton Miller, who shares a unique connection to the driver. During his ARCA qualifying run at the 2.5-mile Pocono Raceway, Townley made hard contact with the wall as he exited the Tunnel Turn before slowing on the track. After the incident, Townley was transported for further evaluation. As a result, Townleys NASCAR Camping World Truck Series team sat out Fridays final practice session as it awaited word on their drivers condition.
