(before I begin, Id like to make it clear that I in no way intend to suggest that rape or assault claims are generally made up by the alleged victims; I apologise to anyone who interprets my post in this way). In a situation where an individual has made a claim about anothers actions, and alleged that the latter has committed a morally unjustifiable offence against them, what consequences might be considered morally justifiable if the original claim is shown to be false? We might argue, on the one hand, that their claim either has had, or could have, serious repercussions for the accused and because of this it is appropriate that they receive a similar treatment (the eye for an eye in its most literal interpretation). On the other hand, we could ask after why they made such a claim in the first place, but in this case we might discover various facts that make it harder for us to justify a severe response. How would we go about working out what is the correct moral response?
