it is the right of Sabah Natives to practice their inherited - TopicsExpress

it is the right of Sabah Natives to practice their inherited culture and rituals, even if they are against Islam (Majority and official religion in Malaysia), Christianity (Majority religion in Sabah). The 18/20 point agreement which serves as the corner stone and preamble towards Sabah and Sarawaks merging with Peninsular Malaya clearly stipulated that the Constitutional clauses of Islam being the official religion of the Federation does not applies to the states of Sabah and Sarawak. Many might argue that these Perkara 18/20 or 18/20 points agreement are not codified into the Federal Constitution hence carry no legal impact. This is a very wrong notion. In the study of Constitutionalism, it is not just the Codified Constitutional clauses that carries constitutional weigtage on legislation. The conventions, preambles, certain statutes and even common law carrying constitutional connotations are to be respected and treated as if they are part of the Constitution too. If you are a Muslim and Christian, and youre offended by the Native Sabahans upacara Batu Sumpah, you are infringing their rights to their religion. you are breaking the agreement with Sabah. They ahve all the rights to rescind their initial willingness to join the federation because of this. Breaking a constitutional promise is an act as grave as Treason. please do not steal away the rights of native Sabahan. This land is theirs as much as it is yours and you are legally bound by the agreement we gave when decided to invite Sabah to join us, as an Equal State.
