To this end there are two primary strategies: One: The Voice Of The People Tour to 30 NB communities public education campaign Two: The NB Water First Legal Action designed to stop the development of Unconventional Oil and Gas by presenting scientific evidence before the court. This evidence will demonstrate the negative impact that this industry will have on the health, the economy, property value, highway infrastructure, the environment and drinking water of NB. With such evidence, that an activity will cause harm, the courts have the power to issue an injunction to stop that activity. Even the credible threat of such an injunction may pressure the government to act. The Legal Fund notes the case of the Petitcodiac River causeway, where after 40 years of citizen activism, it was only the threat of an appeal to the court system that spurred the government to act. THE OBJECTIVE As of March 21st, we have raised $87,000 toward our goal of $100,000. We need your help now to obtain the final $13,000. NB Water First, Inc., in association with New Brunswick Anti Shale Gas Alliance (NBASGA), is seeking a “quia timet” injunction. This is a legal term meaning there is a future probability of injury to our rights, our property and our interests if unconventional shale oil and gas drilling is pursued by the Province of New Brunswick. This can be partly based on injury that has already occurred or projected future injury. A judge is able to grant such an injunction, indicating that there are risks and further questions that need to be answered before this development continues. These same concerns are reflected in the “Chief Medical Officer of Health’s Recommendations Concerning Shale Gas Development in New Brunswick” report that was issued in September 2012. There are thirty community groups, 51 Francophone and 19 Anglophone municipalities, and numerous professional associations that have called for a moratorium. We believe that this court action has the best chance of stopping shale gas development in New Brunswick. BUDGET Legal experts have advised that $100,000 will be required to engage this action. There are two financial phases to the achievement of this court injunction: Phase I. Raise $100,000 . At this time the legal team will be determined as well as the necessary preparation for the court injunction. To this end, community groups and individuals have already raised $87,000. With the approach of the September 2014 NB provincial election, timing of the injunction is critical. Phase II The legal team will prepare the necessary scientists and expert witnesses to bring forth, to the courts, the peer-reviewed scientific, economic and anecdotal evidence regarding the harmful effects of unconventional oil and gas development. The majority of the advised $100,000 objective will be required for this phase and possibly more.
