In the several court cases involving this issue, police tried to argue that recording them falls under state or federal wiretapping laws, which -- depending on the law -- limit or forbid the recording of a third party without that partys permission. The laws, however, are for wire communication and, in every single instance where this has come before an appeals court, the courts have ruled against police. There are, unfortunately, efforts afoot to make wiretapping laws apply to any instance where the material thats recorded is distributed by electronic means. In other words, some police are pushing for laws that could make it illegal for a member of the public to post a video on a social media site without the officers permission. Its a dangerous precedent and people need to pay attention to their state legislatures and fight laws like this.
