In reference to a comment by Dan McGehee on one of my photos. First let me say, I am well aware of the Migratory Bird Treaty Act of 1918. But to satisfy people like Dan I wrote legal counsel to verify the facts. SUMMARY OF THE ACT • The Migratory Bird Treaty Act (MBTA) (16 U.S.C. 703) was passed in 1918 to end commercial trade in birds and their feathers and provide full protection to all native species. • The MBTA is administered by the United States Fish and Wildlife Service (USFWS). • The law specifies that it is illegal to “take” migratory birds, their eggs, feathers or nests without a permit. • “Take” includes by any means or in any manner, any attempt at hunting, pursuing, wounding, killing, possessing or transporting any migratory bird, nest, egg of part thereof. In the United States it is against the law/ illegal to hold a hummingbird, a hummingbird nest, a hummingbird baby, or any part of a hummingbird, nest, or egg, in any type of captivity. DID YOU READ THAT?? IN ANY TYPE OF CAPTIVITY Be aware of the punctuation in that sentence. They are not in my possession [n. the state of having, owning, or controlling something] or captive [n. a person who has been taken prisoner or an animal that has been confined] in any way. I am NOT holding these birds captive, I dont put them in a box, cage, or bring them in my home. I hold them in an opened hand, outdoors. Also, bird banders are licensed and know the laws... would they willingly have people commit an illegal act by handing birds over to non-licensed person to hold? NO.
