13 September 2013 Press statement by MCA Secretary Dato’ Seri Kong Cho Ha on the EGM requisition In view that the current batch of outgoing central delegates are undergoing a transition period, an Extraordinary General Meeting (EGM) cannot be held before 22 September 2013. There is no objection to the requisition for an EGM by MCA Deputy President Dato’ Sri Liow Tiong Lai, but it is not possible to convene it at a date specified by him ie prior to 22 September 2013. The official reply letter has been delivered to Dato’ Seri Liow as well as to three other EGM requisitionists. It should be stressed that during the Presidential Council meeting on 10 September 2013, MCA President Datuk Seri Dr Chua Soi Lek had said that he will not exercise his discretion to instruct the Secretary General to issue a Notice to call for the EGM within 7 days. On that day, 30 Central Committee members had also attended the said meeting. Although the President may exercise his discretion, the expected date of the EGM is bound to fall after the date of the MCA Divisional nominations (16 September 2013) and may even coincide with the Divisional elections (22 September 2013). Presently, MCA Divisions are busy preparing for the Divisional elections and the Division General Assembly in accordance with the Party Constitution. If the Secretary General issues a Notice to convene an EGM, the EGM is bound to coincide with the dates of the General Assembly (22 September 2013) of which there will be a new list of Central Delegates. In other words, if we issue a Notice for an EGM to outgoing Central Delegates and they attend the EGM at a date after a new Central Delegate list has been elected, this will certainly lead to questions on the validity of both outgoing and new Central Delegates attending the EGM which will create legal issues. The 3 EGM requisitionists are also MCA Central Committee leaders. They should uphold the best interest of the Party by avoiding such legal controversies regarding the legitimacy of Central Delegates, as this can place the Party in a legal quandary. From the perspective of the MCA HQ Party Election Steering Committee, as of to date, all Branch elections have been completed. For various reasons, some Central Delegates were no longer elected as Divisional Delegates which means they definitely will not qualify anymore to be elected as Central Delegates. After the Divisional nominations on 16 September 2013, it is expected that many candidates will be elected uncontested. According to past records, about 80% of new Central Delegates will be created after nominations. This means most of the Central Delegates will be created after 16 September 2013 and they qualify to attend the EGM.
