5. Principle: A country may extradite its citizen to another country provided he has committed an extraditable crime. Explanation: A crime incorporated in an extradition treaty is called an extraditable crime. Facts: There’s an extradition treaty between Magadh and Kosal as per which a person may be extradited only for heinous crimes mentioned in the schedule of the treaty. As per the terms of the treaty, the schedule is to be finalized and notified later. ‘Z’, a citizen of Magadh is wanted for dacoity and murder in Kosal and Magadh wants to extradite him to Kosal. ‘Z’ approaches the Supreme Court of Magadh. (a) The Supreme Court of Magadh does not have any jurisdiction in this matter. (b) ‘Z’ cannot be extradited to Kosal. (c) ‘Z’ can be extradited to Kosal. (d) ‘Z’ needs to approach the International Court of Justice in this matter.
