7TH SITTING DRAFT SPEECHES ONLY EFF SPEECHES Thursday, 20 November 2014 LEGIS-15 Ms MASHEGO: Today in the Roodepoort Magistrate’s Court, Court K, a case related to a horrific or rather a series of horrific complex incidents of terror that were unleashed on the Xabanisa family from Slovoville, Soweto, in Ward 53, will be unfolding. This horror was spearheaded by an ANC councillor by the name of Busisiwe Radebe who has been involved in a string of extreme violation of the rights of innocent and law abiding citizens in Slovoville. UGogo [Grandmother] uMrs Xabanisa, a 73 year old resident of Slovoville and her 47 year old daughter, Ms Phumzile Xabanisa who also lives in Slovoville in a different house from Mrs Xabanisa and all their sons and daughters have been systematically and brutally violated, and mistreated by this ANC councillor. The eight-member Xabanisa family have endured brutal assault, murder, repeated arson on their properties, harassment and endured abuse of power. They have been kidnapped; they have endured intimidation, malicious damage to their properties and police brutality and other instances of gross abuse of power by both the councillor and Thursday, 20 November 2014 LEGIS-15 [3] the South African Police Service members who were supposed to be protecting them. All of this was done in the name of forcefully driving them out of their homes because the councillor had a vindictive agenda that she wanted to mete out on the Xabanisa family. In three cases of arson against the Xabanisa family where both women’s houses were burned down, uGogo [Grandmother] uXabanisa lost her 35 year old son on the night of 5 August 2014 when she was held at gunpoint outside her house by a male friend of Councillor Busisiwe Radebe when her house and son were burnt to ashes in full view of the family and the community. This kind of brutality and terrorism against the poor and marginalised African communities of South Africa brought by the ANC government and protected by the South African Police Service within the ambit of the criminal justice system, as we will see the details unfold in this case, must be brought to an end. It cannot be that in a democracy for which we are always reminded that we must be eternally grateful because people have endured harassment, torture and death, that we are now equally harassed, murdered and violated in such horrendous ways. We urge the Premier and [his entire] Executive in the Gauteng Government to please apply their conscience and to use their power in the correct way. The Premier, who is here in the House today, is instructed by the EFF caucus to follow up stringently on the Roodepoort Police Station as well as the Roodepoort Magistrate’s Court to find out the reasons for the refusal of the police station to open an additional murder case to protect the rights and justice of Linda Xabanisa- and also to follow up on the police’s refusal to open the case of murder and also open a case of arson to protect senior Mrs Xabanisa’s home. We also bring to the attention of the Premier and the Executive in the House all the case numbers related to this case, excluding the case of murder and arson. The case numbers are as follows: 624/3/2014; the other case, which is the one that is going to be presented in the magistrate’s court today, is 165/8/2014; and the last case number is 792/3/2013. As citizens and equal citizens of this province, we demand that the Premier- and we instruct the Premier to use his conscience and follow up on these cases.
