ARRESTED/ASKED TO REPORT TO PSNI STATION! 10 IMPORTANT RULES YOU SHOULD FOLLOW: 1. If asked to attend a particular PSNI station at a stated time make sure you attend. If you fail to turn up the next action is that PSNI will arrest you. In doing so you are a “voluntary attender” and are not obliged to remain if the interview gets a ‘bit too hot for you’. 2. Before going to the PSNI station contact a solicitor and ask him/her to be present to represent you – you WILL NOT have to pay for this FIRST PACE interview as Legal Aid covers this cost – Ask a well known solicitor who has agreed to act on behalf of Unionist protestors in the local area 3. If you are arrested in a PSNI early morning swoop make sure you demand the right to be legally represented – the police must allow you to telephone your solicitor – DO NOT ANSWER any questions regarding the allegations that the PSNI are making against you until you solicitor arrives other than to make clear your personal details, that is, your name and address 4. When your solicitor arrives at the PSNI station ask for time alone with him/her to discuss your situation prior to a police officer tape recorded interview 5. Always take advice from your solicitor – he/she will be acting in your best interests 6. Under Police and Criminal Evidence Order; the interviewing officer must provide the evidence against you at the interview. He must explain in lay-mans terms the nature of offence or offences they allege you have committed. Take, read and ask questions about the caution “You are not obliged to say anything etc etc.” they administer before the interview. A “No comment” interview gives you NO CHANCE at a later date to defend yourself. 7. DO NOT admit liability for any alleged offence that the PSNI are alleging against you. 8. When you are shown video evidence of your alleged offence during interview DO NOT admit that you are the one shown on the video or that you were even there. Tell them, “That is for PSNI to prove”. Always challenge by word anything you do not agree with. Where there is evidence of police viciousness always demand the officers identity number for the purpose of a complaint. REMEMBER: - you are ONLY there to defend YOURSELF and speak for your OWN actions. DO NOT name or blame others!. 9. If your solicitor starts to speak at any time during your interview always give way to him/her – they are the legal professional 10. If you are released without charge always request a copy of your interview tape by writing to the officer in charge of the Police Station where the interview occurred. THESE PEOPLE ARE NOT OUR FRIENDS! IF THEY CAN THEY WILL PROSECUTE YOU!
