AUSTRALIA TWO TRUCK DRIVERS WHO WERE SACKED BY MINING GIANT FOR USING PHONE WHILE WORKING AT COAL MINE WILL GET THEIR JOBS BACK AS FAIR WORK HELD THEIR TERMINATION WAS HARSH UNJUST AND UNFAIR 29TH DECEMBER 2014 Sacked BHP Billiton truck drivers get jobs back after Fair Work Commission hearing TWO Queensland truck drivers sacked for using their phones while working at a coal mine will get their jobs back after the sackings were found to be “harsh, unjust and unfair”. Luke Faulkner and Shannon Boal, 43, from Mackay, were sacked in February after they were caught using their phones in separate incidents during 12-hour shifts in January. Faulkner was dobbed in to management by a fellow worker who was a Facebook friend, after he posted a comment about a truck on January 23. Faulkner, who worked at the mine for six years, told a Fair Work Commission hearing that he posted the comment while his dump truck was being loaded by a shovel at BHP Billiton’s Goonyella Riverside Mine in Central Queensland. He wrote: “Your (SIC) lucky I’m here to get your truck out of the bog you got it into.” He argued he only used his phone while the truck was stationary and he turned it off before driving off. Boal, who worked at the mine for nine years, was sacked after his mobile phone was found in his truck on January 22. He denied ever using his phone while operating, but after he handed over his phone records to his bosses, they argued he had sent texts while operating his truck during other shifts. Commissioner Paul Spencer ordered both men be given their jobs back after he found BHP had let other workers busted on their phones keep their jobs. “Other employees who have breached the procedure for mobile electronic device usage at the workplace have continued their employment,” he said.
