Advice on filing for Social Security Disability Before you consider filing for permanent disability, a doctor needs to determine that you are disabled and longer able to work. This can only be filed for after you have not been able to work for two years. Over and over I have seen people ask if they should get an attorney to file for SSDI or SSDA if you have not earned income yet. I believe that you should try on your own first. Though we hear of those who have had to fight especially for Fibromyalgia this is now a recognizable disease. Back cases pending are being approved so even with those hard to see and prove conditions now are being approved. Always try first w/o!! Sometimes getting an attorney involved at the get go isnt necessary and may even look like you are suspecting a denial. Only you know your body and your capabilities. Have certainty that your doctor knows what he is doing. You know in your heart if you will ever be able to work again. Being on SSDI or A Doesnt mean you have to stay there forever! Have hopes and faith that life can always improve ... in the meantime try filing the applications yourselves. Funny as work comp followed me via private eyes twice for 2 days, this is what transpired at my first SSI application meeting. Walked in wearing a shoulder brace, neck brace and using a cane. I was at time tearful to have to go to the office when practically bed-ridden told them I was awaiting surgical approval. Had my discogram (xray) with three-blown cervical discs that needed removal and fusion. I also had work comp medical and psyche evaluations that of course were conflicting ...! The worker was very empathetic and quite concerned about the pain I was in. Most likely I was driving and unmediated. She told me with the conflict of medical opinion it may be difficult so not to despair if that were denied as I would easily qualify under the psyche. My approval for med disab came in before 90 days :-/
