After a several month long investigation, on December 13, 2004, the Herkimer / Mohawk Police Departments Special Response Team, with the assistance of New York State Parole & members of the MOVAC Medical Response Team executed a search warrant at 215 North Main Street Apartment 12 in The Village of Herkimer. During the search warrant execution, Officers located narcotics, marihuana, drug packaging materials, paraphernalia and a scale. The Herkimer County District Attorneys Office also assisted with the investigation. As a result of the search warrant, Herkimer Police arrested David L. Simmons and Jessica Z. Barreto. Simmons was charged with one count of each of the following. Criminal Sale of a Controlled Substance 3rd Degree, a class B Felony. Criminal Possession of a Controlled Substance 7th Degree and Criminally Using Drug Paraphernalia 2nd Degree, both class A misdemeanors. Unlawful Possession of Marihuana, a violation. Simmons was arraigned in the Town of German Flatts court and remanded to the Herkimer County Correctional Facility without bail. Barreto was charged with one count of the following: Criminal Possession of a Controlled Substance 7th degree, Criminally Using Drug Paraphernalia 2nd degree, both class A Misdemeanors and Unlawful Possession of Marihuana, a violation. Barreto was transported and held at the Herkimer County Correctional Facility on a Parole Warrant. Both suspects are presumed innocent until proven guilty in a court of law.
