Alachua County should challenge the proposed Minimum Flows and Levels rule for the Lower Santa Fe and Ichetucknee Rivers. I anticipate making a motion to do so at the Board of County Commissioners meeting on Tuesday (3/25) sometime after 10 AM. I am now convinced that having no adopted MFL rule, especially one with such a diluted recovery plan, is actually better than allowing the deeply flawed rule to proceed towards adoption. Alachua County is likely to be only one of a number of intervenors in the administrative hearing process. But we should not sit back while small non-profits do all the heavy lifting, especially since well-funded challengers may intervene to prop up the damage theyve already done to the rule and our water resources. Nobody likes it when government agencies tie up valuable resources litigating one another. But the corruption of this process, and resulting damage to our rivers and springs has to be stopped. We need folks who have concerns about this to participate in the discussion, as the County has a narrow window in which to prepare and file our legal challenge.
