Categorical Exclusions: Extraordinary Circumstances must be reviewed for applicability. When no “extraordinary circumstances” apply, the following activities do not require the preparation of an EA or EIS. The following actions are designated as categorical ....Minor modification of water developments to improve or facilitate wildlife use Relocation of nuisance or depredating wildlife, providing the relocation does notintroduce new species into the environment. .Oil, Gas, and Geothermal Energy.....Issuance of future interest leases under the Mineral Leasing Act for Acquired Lands, where the subject lands are already in production.2.Approval of mineral lease adjustments and transfers, including assignments and sub leases. 3. Approval of unitization agreements, communitization agreements, drainage agreements, underground storage agreements, development contracts, or geothermal unit or participating area agreements. 4. Approval of suspensions of operations, force majeure suspensions, and suspensions of operations and production. 5. Approval of royalty determinations, such as royalty rate reductions. 6. Approval of Notices of Intent to conduct geophysical exploration of oil, gas, or geothermal, pursuant to 43 CFR 3150 or 3250, when no temporary or new roadconstruction is proposed.
