Are you an ALECO member consumer? Come September 14, 2013 let your voice be heard! Do you agree with the other member consumers who signed the following MANIFESTO? -------------------- M A N I F E S T O -------------------- “IT IS NO LONGER FUNNIER IN THE PHILIPPINES, ESPECIALLY IN ALBAY, BUT RATHER SHAMEFUL TO BE KNOWN ALL OVER THE WORLD THAT ALBAY IS THE LAUGHING STOCK AND CENTER OF MISGOVERNANCE ON ELECTRIC COOPERATIVES DUE TO THE PhP 4 BILLION DEBT!” The undersigned member consumers of Albay Electric Cooperative (ALECO), Inc. through this MANIFESTO, have for the present and past years endured the inconvenience of brown outs, high cost of electricity bills due to the mismanagement and inefficiency of the past and present National Electrification Administration (NEA) Project Supervisor for ALECO, the past and present Interim ALECO Board of Directors, officers as well as employees in charge of collections and disconnections of delinquent consumers, that has resulted to the increase of liabilities of ALECO in the amount of more or less PESOS: FOUR BILLION (P4B). It has been observed by us, that when NEA in the past years took over the management of ALECO for its continuous failure to pay its liabilities to the government and the power supplier, the debt was then only in the range of millions. The member consumers were expecting that with the entry of the government through the NEA technocrats under the Department of Energy (DOE), ALECO would be in good hands. ALECO has the monopoly of providing electricity to its member consumers. However, how come that instead of paying off or reducing the debts or losses of ALECO, the millions has become billions? Is this another billion scam of public officials and employees with the connivance of some of the past and present ALECO Board of Directors and employees, to hide the truth on why they are protecting electric consumers who are delinquent in their payments? ALECO has a policy that reimposes 2% penalty for late payments and disconnection for none payment of their electric bills after two (2) months. However, why is it that some consumer electricity has not been disconnected, or why it took them so long to disconnect the electricity, especially on business establishments and residences of consumers who are public officials and employees? Atty. Veronica T. Briones, NEA Project Supervisor for ALECO, together with the present Interim ALECO Board of Directors continue to refuse to post the names of the delinquent consumers, especially those whose electric consumption are substantial in amount as per verbal and written request. Again, they continue to fail to have the matter approve by the General Assembly in a special meeting to be called for such purpose, in order for the delinquent accounts to be posted in the collection offices, instead of hiding in the reason that a court order or permit of the delinquent consumer is needed before all delinquent accounts can be posted and be made known to ALECO member consumers. This COMPLAINT in the form of a MANIFESTO, that it is only just and proper that violations of the provisions of R.A. 6713, the Code of Conduct and Ethical Standards for Public Officials and Employees be made known to all concerned persons and ALECO member consumers. Under Section 4 (c), Justness and sincerity. Public officials and employees shall remain true to the people at all times. They must act with justness and sincerity and shall not discriminate against anyone, especially the poor and the underprivileged. They shall at all times respect the rights of others, and shall refrain from doing acts contrary to law, good morals, good customs and public policy, public order, public safety and public interest. They shall not dispense or extend undue favors on account of their office to their relatives whether by consanguinity or affinity except with respect to appointments of such relatives to positions considered strictly confidential or as members of their personal staff whose terms are coterminous with theirs. And, under Section 5 of Duties of Public Officials and Employees; in the performance of their duties, all public officials and employees are under obligation to: (a) Act promptly on letters and requests. All public officials and employees shall, within fifteen (15) working days from receipt thereof, respond to letters, telegrams or other means of communications sent by the public. The reply must contain the action taken on the request; (e) Make documents accessible to the public. All public documents must be made accessible to, and readily available for inspection by the public within reasonable working hours. Whereas, under Section 3 (e), corrupt practices of public officers under R.A. 3019, the Anti Graft and Corrupt Practises Act. Causing undue injury to any party, including the Government, or giving any private party any unwarranted benefits, advantage or preference in the discharge of his official, administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence... (f) Neglecting or refusing, after due demand or request, without sufficient justification to act within a reasonable time on any matter some pecuniary or material benefit or advantage, or purpose of favouring his own interest or giving undue advantage in favor of or discriminating against any other interested party. (g) entering, on behalf of the Government, into any contract or transaction manifestly and grossly disadvantageous to the same, whether or not the public officer profited or will profit thereby. (h) Directly or indirectly having financial or pecuniary interest in any business, contract or transaction in connection with which he intervenes or takes part in his official capacity, or in which he is prohibited by the Constitution or by any law from having any interest. (i) Directly or indirectly becoming interested, for personal gain, or having a material interest in any transaction or act requiring the approval of a board, panel or group of which he is a member, and which exercises discretion in such approval, even if he votes against the same or does not participate in the action of the board; committee, panel or group. Interest for personal gain shall be presumed against those public officers responsible for the approval of manifestly unlawful, inequitable, or irregular transactions or acts by the board, panel or group to which they belong. We hereby request the Office of the Ombudsman to conduct an investigation of the past and present DOE Secretary, NEA Project Supervisor for ALECO, the Albay Governors who served as ALECO Chairman of the Board of Directors, other public officials and employees, when NEA took over in the past, and STEP IN at present, as provided for under the Department of Energy (DOE) Circular No. DC2013-07-0015 of R.A. 10531, and violations of the above provisions of R.A. 6713 and R.A. 3019. 1. The accountabilities of the past and the present DOE Secretary Carlos Jericho I. Petilla, NEA Project Supervisor for ALECO, Atty. Veronica T. Briones, Engr. Russell G. Serrano, ALECO General Manager, past ALECO Chairman of the Board, Governor Al Francis Bichara, now Congressman of the 2nd District of Albay, Fernando Gonzales, now Congressman of the 3rd District of Albay, and Incumbent Governor Joey S. Salceda, other members of the Board of Directors, their role and participation in the none payments and failure to collect the debt of delinquent consumers, especially from among public officials and employees business establishments and residential houses. 2. DOE Secretary Carlos Jericho I. Petilla through the recommendation of the ALECO Project Supervisor and the Interim Board, has approved a referendum on September 14, 2013 for member consumers to select an option for a Cooperative to Cooperative (C2C) or Private Sector Participation (PSP), which is contrary to the Department of Energy Circular No. DC2013-07-0015 of R.A. 10531 that the selection must be for a stock cooperative or stock corporation. The existing ALECO cooperative is a non stock and non profit cooperative. None enclosure in the referendum or special general assembly meeting of the option by member consumers to select ALECO as a stock cooperative is in violation of the mentioned DOE Circular. 3. The accountability of the ALECO purchasing department if all purchases conforms to quality, standard and bidding requirements. Overpricing of equipment and assets must be thoroughly verified. 4. The accountability of the ALECO Collection Department why they continue to fail to collect the amount from electric consumers with past due accounts of more than two (2) months. 5. The accountability of the ALECO Disconnection Department on why they failed to disconnect the electricity on all consumers for none payment of electricity bills for more than two months, especially on business establishments and residences owned by public officials and employees. 6. The accountability of the ALECO Administrative Department on failure to file, suspend and or terminate ALECO employees found to have conspired with consumers on electricity pilferage, especially on public officials and employees business establishments and residences. 7. That, all public officials, employees and private citizens who committed, conspired, and were involve in the violations of the above quoted pertinent provisions of R.A. 6713 & R.A. 3019 laws must be charge and penalized accordingly.
