Big Labor couldnt ram its power grabs through Congress, so it turned to Plan B: Imposing unionization on American workers by executive fiat. As a result, American workers have had to wait three years just to have the opportunity to kick out a union they didnt want in the first place. You see, union bosses wanted payback for their billions of dollars of support for union-label candidates in recent election cycles. Barack Obama was happy to oblige, particularly through the out-of-control National Labor Relations Board (NLRB). The NLRB has bulldozed its way through workers rights and the Boards own precedents to hand Big Labor many new special privileges. For example, three years ago, three former union lawyers on the National Labor Relations Board voted to overturn the Boards pivotal 2007 ruling in Dana Corp. The National Right to Work Foundation-won Dana case was one of the most important victories for workers rights at the Board in recent years, securing for employees the right to challenge union card check organizing campaigns with a secret ballot vote. Workers often sign so-called union authorization cards due to union organizers intimidating tactics or even outright lies about what signing a card means. But thats not all. The Obama Labor Board was so desperate to kill the Foundation-won precedent, then-NLRB Member Craig Becker refused to recuse himself from Lamons Gasket, the case overturning Dana, even though he authored a brief for the AFL-CIO in the original case. And by overturning Dana, the Obama Labor Board destroyed thousands of secret ballot votes by workers who wanted to remove unions that invaded their workplaces through the abusive card check process. Lamons Gasket workers in Houston, Texas, have had to wait three years for the opportunity for a new secret-ballot vote. Theyll finally have the opportunity next week. The Obama NLRB has denied justice for these Lamons Gasket workers for three years. No matter what you may have heard, card check isnt dead yet. And the Obama Labor Boards all-out assault on individual workers isnt over either. Thats why we must remain vigilant. Sincerely, Mark Mix
