Big win for our constitutional rights in McLean County, Illinois! Today, we won a hotly contested motion to suppress illegally seized evidence. As a result, the prosecutor dismissed all charges against our client. An Illinois State Trooper stopped a vehicle for a minor traffic offense and then proceeded to search our client, a passenger of that vehicle, based solely on his prior criminal history. After 3 days of hearings, the Court agreed with us that this search was performed on a mere hunch and thus unreasonable (in other words - illegal). The law protects ALL citizens from unreasonable searches.
