Brady Fulton wins summary judgment for defendants in patent infringement case. Representing three small companies who were accused of willfully infringing a U.S. patent relating to high-voltage transformers used in x-ray equipment, Brady successfully argued that the patent asserted against his clients was both invalid and not infringed. A large company based in Spain that manufactures and sells x-ray equipment around the world had sued Brady’s clients, alleging that their competing products infringed the Spanish company’s patent. Brady singlehandedly fought the case through extensive fact and expert discovery against multiple attorneys from two large law firms, and then moved for summary judgment. Agreeing with Brady’s arguments, the U.S. District Court for the Western District of North Carolina declared the Spanish company’s patent invalid because the patented devices are “inoperable” in violation of sections 101 and 112 of the United States Patent Act. The Court also accepted Brady’s argument that his clients’ competing products would not infringe the patent, even if it were valid. One of Brady’s clients thanked him in an email, stating: “Thank you so much for your magnificent job done on our case. We could not be any happier . . . . Once again, I sincerely thank you for helping us with your brilliant mind. I could not imagine that we would get this result without you.”
