Breaking News: Jurors in a civil trial involving the city of Atwater have determined the city is responsible for the 2010 crash that killed a pedestrian at the intersection of Bellevue Road and Linden Street. The verdict means the city will have to pay around $3.2 million to the family of Delia Gonzales, 73, the victim in the case. The verdict was reached just after 4 p.m. Monday. In the lawsuit, the city of Atwater was accused of negligent design of the intersection. The lawsuit was filed by Gonzales’ surviving spouse, Genovevo “Gene” Gonzales, and her children, according to court documents. The lawsuit also named as a defendant Michelle Carrizales, a Merced County resident who was driving the vehicle that killed Gonzales. Jurors determined Carrizales was not at fault for the crash. The family claimed the city is responsible for designing, constructing, maintaining and supervising safe public roadways. The lawsuit said Gonzales died as a direct result of “negligent design” of the intersection, including visual obstructions, improperly timed traffic signals and inappropriate roadway maintenance, pavement striping and signage.
