Buckland Farm has an update for those who have been following our situation. Of late, the focus of posts on this thread has strayed from finding Kaya and bringing her home, to finger pointing and questions about ownership and other matters. Several have now asked what the missing parts of the puzzle are, and so I will try to address that as neutrally as possible. Two posters here, @Julia Glazer and @Cat Baumgartner, have suggested that there is another owner of Kaya, and that that person is also a co-owner of Buckland Farm. That would certainly change things, so let’s have the other shoe drop now. A woman named Carrie Megginson is the person Julia and Cat refer to. Carrie and I started Buckland Farm in 2010 to pursue sustainable agriculture and the betterment of our community. Buckland Farm is not a thing, but rather an intellectual property that is the sum total of the efforts put in by those who care for, contribute to, and work here. Carrie last year renounced being a part of Buckland Farm and moved from the property in September 2012. Carrie is not a co-owner of Buckland Farm, but rather is the co-owner of the mortgage/deed for 793 Morral Rd in Clearville, PA. The deed was obtained through a legal construct called a General Partnership. Carrie and I never married, and we do not jointly own anything other than the deed/mortgage. She stopped contributing to mortgage payments when she left. Since then, I have sought, through the employment of an attorney, to negotiate a settlement with Carrie to dissolve the General Partnership and move on with Buckland Farm . There has been little engagement in negotiation from Carrie to this point . In dissolving our agreement there needs to be disposition of the deed/mortgage, and also distribution of the “things” on the property. Since we own no property besides the deed/mortgage jointly, all the “things” belong to someone individually. In some cases this is simple, Carrie’s books belong to Carrie, Dan’s air compressor belongs to Dan. Some “things” may be in disputed ownership, and in that case the best option in my view would be to negotiate, then arbitrate, then litigate if necessary, which is pretty standard practice. I have asserted that Kaya belongs to me, and have backed that assertion with licensing information, which carries some legal weight. Kaya has been resident on the property for 3.5 years until last Saturday when she was stolen. The last 10 months she has been solely in my care. I believe I am legally correct in my assertion of owning Kaya on behalf of Buckland Farm. If Carrie, or anyone for that matter, believes they have a legal right to own Kaya, I believe the correct and legal course of action would be to negotiate Kaya’s status, arbitrate failing negotiation, and finally litigate if necessary. I’m certain that taking her forcibly from the property is not acceptable behavior, yet that is what was done. Now legal problems are in the mix for some. Over 400,000 people have looked at this thread now, and many are looking for Kaya to help resolve the question of her location. I feel that Julia Glazer and Cat Baumgartner, in writing that this is a custody dispute and that the whole story is not known, are suggesting that Carrie Megginson may be the real owner of Kaya, and that they hope for Kaya to be with Carrie. The amount of energy and resources being expended looking for Kaya and dealing with things like this FB thread are sapping the farm’s resources at a time we are grieving the loss of our dog. This is a serious misallocation of resources if Kaya’s whereabouts are either known or can be found out. I ask that Cat and Julia contact their friend Carrie and ask her if she has Kaya, or knows anything about where Kaya is, and then post the contents of Carrie’s reply on this open forum. If Carrie does not know anything of her whereabouts, then we must continue to search for Kaya and I will continue to seek all assistance available from those on FB who will look for her with us. But if Kaya is with Carrie at this point, for her to conceal this would be a tragedy on many levels. Cat and Julia, will you do this simple task for the 400,000 people who have cared on some level about this matter? If you decline, may I respectfully ask that you stop posting innuendo and darkly veiled criticisms of me and of Buckland Farm so this thread can focus on locating Kaya? To paraphrase your friend Carrie, if you won’t be a part of the solution, will you not be a part of the problem? Let’s get this back on track, and do the right thing for Kaya and for all concerned.
