The Netherlands Authority for Consumers & Markets (in Dutch: Autoriteit Consument & Markt) has recently issued a press release regarding the unlawful practice of real estate brokers to charge a fee -- typically one months rent -- to prospective tenants when the broker has been engaged by the owner of the housing premises to solicit and arrange for tenants, for example by advertising the premises online. The typical practice to date has been that the owner of the house or apartment and the tenant which signs the lease both make payments to the real estate broker. The ACM has now made it clear that this is an unlawful practice due to the conflict of interest which emerges from this practice. Real estate brokers advertising a house or apartment for rent should therefore not charge a fee from the prospective tenant. If you are faced with such an unlawful practice, you may wish to provide the real estate broker with a copy of the ACM press release and request that the apartment or house is rented to you without the fee or commission. Further you may report the unlawful practice by contacting ConsuWijzer.nl, the agency registering complaints for the ACM. The current legal framework disallowing the collection of fees from both the owner and tenant only applies to the renting of houses and apartments. The legislation is due to be amended in the near future to apply to the renting of single rooms as well.
