CARMEN ELLIS 3YRS (5-19-2009 TO 1-30-2012) (KB-Samantha Ellis & Jose Cruz-Bio Mother & Bio Mothers Boyfriend) MOTHERS BOYFRIEND, JOSE CRUZ, CHARGED WITH MURDER-GIRLS LAST WORDS WERE: PAPA, I HATE YOU August 24th, 2012 @12:51 PM The last words of a 3yr old girl who was taken to the emergency room covered in bruises and bite marks were, Papa, I hate you, according to court documents. Carmen Ellis, a beaming little girl with big brown eyes, was taken off life support after succumbing to her injuries. Jose Cruz, the boyfriend of Carmen Ellis’ mother, told investigators that he lost his temper with the girl, beating the toddler repeatedly with a belt and shaking her, the documents read. Little Carmen Ellis, 3yrs, was found in her mothers home unresponsive and covered in bruises and was later taken off life support; her mothers boyfriend, Jose Cruz, has been arrested over her death. Cruz said that he blanked out and lost it after Carmen began vomiting. Her mother, Samantha Ellis, told investigators that Cruz insisted her daughter would heal on her own and did not want to take her to the hospital. He is charged with murder, and will next appear in court in November. Until then, he is being held in solitary confinement. Police received a call to go to Long Wharf Drive in Warren Woods, Indiana, about 13 miles outside Indianapolis. That’s when police discovered little Carmen in a bedroom with her mother, limp and allegedly covered head-to-toe in bruises. The girl was rushed to the hospital and put on life support. She was kept alive until her organs could be donated. Officers found Cruz in the house wearing a sopping wet T-shirt and looking crazed. This isn’t Cruz’s first brush-in with authorities. In July, a concerned neighbour called the police last month, reporting possible bite marks on the girl’s face. However, the case was handed over to Child Services. Carmen’s grandmother, Tina Ellis, said: Carmen is a beautiful three year old girl. She is smart, very smart. Authorities said Carmen’s mother is currently not facing charges, but could, based on what officers find in their on-going investigation. UPDATE: August 6th, 2014 SAMANTHA ELLIS SENTENCED TO 20 YEARS IN DAUGHTERS DEATH Indianapolis, Indiana-Marion County Prosecutor Terry Curry announced that Samantha Ellis received a 20-year executed sentence at the Indiana Department of Correction, followed by a probation period of ten years for her role in the death of her 3yr old daughter, Carmen Ellis. The sentence was ordered pursuant to a plea agreement in which Ellis pleaded guilty to Neglect of Dependent Resulting in Death (A Felony) for failing to obtain timely medical treatment for Carmen and failing to remove the child from the presence of Jose Cruz, which resulted in the girl’s death. While I wish there would never be a need to prosecute a case such as this, it was imperative that both Jose Cruz and Samantha Ellis be held responsible for the death of 3yr old Carmen, Marion County Prosecutor Terry Curry said after Ellis’ sentence was ordered. Carmen’s life must not be forgotten, and her death should serve as a reminder to parents and anyone else who has the responsibility for protecting a child that there is no justification for leaving a child with a person who is any way suspected of harming that child. Nothing should rise above a child’s right to be safe in his or her own home. Ellis’ former boyfriend Jose Cruz received a 75-year executed sentence in October of 2013 for the 2012 beating death of Carmen Ellis. Cruz pleaded guilty to Murder, as well as a charge of Aggravated Battery (B Felony) for an assault that preceded the fatal beating. Seventy-five years is believed to be one of the longest sentences given.
