CAVEAT EMPTOR - LET THE BUYER BEWARE A good friend of mine was offered by his uncle to buy the SMARTPHONE which was purchased abroad. After my friend agreed and paid his uncle and after few weeks of using the item he later discovered that the SMARTPHONE is defective. The Smartphone was purchased in DUBAI and his uncle is now migrating to U.S.A. Question: Can he recover damages or ask for the return of his money ? Under the principle of caveat emptor, the buyer could not recover damages from the seller for defects on the property that rendered the property unfit for ordinary purposes. The only exception was if the seller actively concealed latent defects or otherwise made material misrepresentations amounting to fraud. Does the principle of CAVEAT EMPTOR applies here? Does Caveat Emptor principle only applies in Real Property...meaning, Land, House, and excludes Movable Properties like Car, Cellphone, Smartphone. I will discuss in my next FB post. By: N. TAMAYO
