Cakeshops vs the Bible I expect that we’ll see a lot more heat from this issue, though probably not much light. Basic situation: (1) two years ago a Colorado cakeshop refused to make a wedding cake for a gay couple due to “religious reasons”. The shop was taken to court, and found to have broken discrimination laws. (2) last year a man came into a different Colorado cakeshop and asked for two Bible-shaped cakes with homophobic representations on them. The owner agreed to make the cakes, but not do the words (“God Hates Gays”) or the design, and offered to sell the customer extra frosting so he could write whatever he wanted. The man refused this deal and filed a religious discrimination complaint against the shop. (Boggles the mind, right? But I digress…) So in case #1 the business owner denied service to someone for claimed religious reasons, which is still illegal in this country. In case #2 the business owner did not refuse to bake the cakes, just to write the hate speech. One legal opinion on this I just read said that to require owner #2 to write those words “would infringe upon her own free speech rights.” Or, as I would put it, baker #1 was standing up for hate, while baker #2 was standing up for love.
