Court transfers case seeking to replace Suntai An Abuja Federal High Court has transferred to its Taraba state division a case seeking to compel the state’s executive council and its House of Assembly to comply with section 189 of the 1999 constitution and make the state’s deputy governor, Garba Umaru, substantive governor in the absence of Governor Danbaba Suntai. In the suit filed through their counsel Yahaya Mahmood (SAN), 16 plaintiffs who were led by Senator Saleh Usman Danboyi asked the court to determine whether having regards to the provision of section 189 and Suntai’s present health condition, the state assembly is constitutionally under obligation to comply with the provisions of the section. Joined as 1st to 4th defendants are the Peoples Democratic Party (PDP), Attorney General of the Federation, Attorney General of Taraba State and the Taraba State House of Assembly. The plaintiffs want the court to determine whether in view of Suntai’s present health condition, the defendants, particularly the PDP and the Attorney General are not constitutionally under an obligation to direct that Section 189 of the 1999 constitution be complied with. In an affidavit deposed to by Danboyi, he averred that the plaintiffs are concerned about Suntai’s rumored incapacitation and the condition is affecting the progress and development of the state. When the matter came up yesterday however, Justice Evans Chukwu held that the suit should be filed at the Taraba division of the court since there is no security threat in the state.
