Cranium Update - Please read my earlier post today on the function of the Grand Jury in the American Justice System. St. Louis Prosecutor McCulloch should be forced to defend his highly questionable presentation of Probable Cause evidence before the Grand Jury in the Ferguson matter to the Missouri State Bar. And if it is found that he failed at his ethical duties, he should be sanctioned or disbarred. If he successfully defends his actions - then no foul. Thats how it works. Its irrelevant what you think of the Michael Brown altercation with Officer Wilson. Its irrelevant what where the guilt and innocence lie and to whom they are attributed. Thats for a Trial Jury to decide. The ONLY purpose for a Grand Jury is to determine whether there is enough evidence to find Probable Cause. Which doesnt mean ALL evidence or ANY mitigating evidence. Merely means the evidence necessary to establish Probable Cause to go TO trial. And when a Prosecutor - who is ethically bound by his oath given to the State Bar and the people of St. Louis - saliently fails to properly and zealously (yes, Attorneys are held to a Zealous standard) fulfill his duties, he should be held accountable.
