DOG BITE QUESTION: My neighbors have a Rottweiler that is pretty violent. Normally they have him chained and fenced in their back yard but a few moths ago it escaped and bit my son in the face. His bite required several trips to the hospital and 35 stitches. His arm was also broken in the struggle with the animal. The medical bills were covered by our insurance and since my neighbor took extra precautions and seemed really apologetic, I did not see the need to sue. A few weeks after the bite, my son developed an infection that has made his scaring worse. I’ve been told that he will need plastic surgery that is not covered by insurance. My son may be permanently disfigured. It turns out that my neighbor is not the owner of the property and is a renter. Is there anyway I can sue him or the owner of the property for the medical bills, pain and suffering? GOINS LAW: Maybe. Technically, the owner of the home is covered under the homeowner’s insurance policy and that policy may or may not extend to the renter. You can sue the renter, but he may not have an insurance policy for you to sue. If you can prove that the owner of the property knew about the dog and it’s propensity to bite and they still allowed the dog on their property, you may have a case to sue the actual owner.
