Sir/Madam, Re: Application u/s 6 of the Right to Information Act, 2005- With reference to the above, please furnish the following information at the earliest & oblige. 1. Whether ICAI Act, 1949 , or the directions of Central Council of ICAI, permits all 5 Regional Councils and all the Branches of Regional Council to organize the following functions and to spend the ICAI Funds on such functions: (i) Felicitation of President, Vice President, Central Council members, Regional Council members (ii) Cultural Programs on the eve of CA Day Celebration, on the eve of New Year, by what ever name called (iii) Holi Milan, Family get together etc. (a) If yes, please supply a copy of the relevant regulation of the ICAI, ACT, 1949 and/or the Central Council Directions in this regard (b) If No, please confirm 2. Whether all the 5 Regional Councils and all the Branches of Regional Councils have spent amount from ICAI funds on (a) Cultural Evenings on the eve of CA Day Celebration /CA Pariwar Prastuti/CA Mahotsav (b) Holi Milan(c) Cultural evening on new year eve and (d) Family get together (e) Felicitation of President, VP, Central Council and RC members (a) If yes, please provide details of amount spent on above mentioned functions for the year 2009-10,2010-11-2011-12,2012-13, and from 1-4-2013 to 15/08/2013 by each of the 5 Regional Councils and the accounting head of the Audited Accounts of ICAI, where such expenses have been shownkindly provide the name and designation of the sanctioning and approving authority, and amount sanctioned and approved (b) If No, please confirm 3. Whether cultural program in the year 2009-09, organized by the NIRC, in which famous film actress Hema Malini and famous play back singer Shreya Ghosal, performed, were sanctioned and approved by the Central Council of ICAI? (a) If yes, please provide us a copy of the relevant minutes of the Central Council meeting (b) If No, please confirm (c) Please provide the amount of expenses incurred on these two programs by NIRC, name and designation of the authority who sanctioned and approved these expenses and the accounting head of the audited accounts of the NIRC, where these expenses were booked. 4. Whether rules and regulations of the ICAI Act, 1949 or the directions of Central Council of ICAI, permits all the Committees of the Central Council to organize cultural programs and to spend ICAI funds for that purpose? (a) If yes, provide us the copy of the relevant regulation/council direction (b) If no, please confirm (c) Please provide information on the amount of expenses incurred by each of the committee on such programs from 2009-10 to 2010-13 5. Whether rules and regulations of the ICAI Act, 1949 or Central Council Directions, permits all the 5 Regional Councils and the Branches of Regional Councils to organize the following activities in the premises of the Regional Council/Branch: (i) Any Religious activity-Christmas Prayer, Offering of Namaz, Mata ka jagran etc. (ii) Any activity jointly with any club, any NGO which is not directly or indirectly related to the activity of the ICAI i.e. spreading knowledge and education in the field of accountancy (iii) To allow the students to celebrate birthday parties in the classrooms (iv) To organize certificate distribution function to all GMCS students/members (v) To give new year eve, diwali, holi, greetings and wishes in the news papers with their photograps (vi) To place hoardings in the city for wishing greetings on festival, Republic day/Independency day or for any occasion with their photographs (a) If yes, please supply a copy of the relevant regulation of the ICAI, ACT, 1949 and/or Central Council Directions in this regard (b) If No, please confirm 6. Whether there is any code of conduct, for the elected representatives of the Managing Committees of all the 5 Regional Councils and the Managing Committee of all the Branches of the Regional Councils, in case of (a) any violation/non-compliance of the ICAI Act, 1949 or any direction of Central Council of ICAI Direction (b) Misutilisation of ICAI Funds for the activities, not permitted under the ICAI Act, or under the Council Directions? (a) If yes, kindly confirm and supply the copy of the same (b) If No, please confirm I therefore request you to kindly give me reply u/s 6 of the RTI Act, 2005, as per the details mentioned in the application.
