Dear All, The dictionary meaning of Allege: ------------------------------------------------------------------------------------------------------------------------------ Allege [uh-lej] Verb (used with object), al•leged, al•leg•ing. 1. to assert without proof. 2. to declare with positivity; affirm; assert: to allege a fact. 3. to declare before a court or elsewhere, as if under oath. 4.to plead in support of; offer as a reason or excuse. ------------------------------------------------------------------------------------------------------------------------------- Why is a respectable person, in this case former Judge of the Honourable Supreme Court of India, Justice (Retd) AK Ganguly, who is currently serving as the Chairman of the West Bengal Human Rights Commission, being tortured based on only ALLEGED claims? WHY can we not have under the law, to first fully CONVICT and then let the media Defame / Debate that person / event? WHY should there be no Defamation, Mental Harassment and Act of Causing Irreparable Personal and Professional Damage, resulting in severe Trauma, career & other losses charges /law suits against all media and other personnel who have without lawful trial and conviction destroyed a person’s image and self-confidence? It would bring a lot of heartache and pain (due to the state of affairs in the way things are conducted in our country), if not surprise, in case he is asked to resign from his current role based on these ALLEGED charges. What if he is innocent but out of sheer pain (and lack of ability to sustain trauma - thanks to perils of older age) does something like a self-harming act just to escape the irreparable humiliation he has suffered even while being innocent? Although I sincerely wish God grants all strength to him to fight and prove himself not guilty, but I am worried of his time and uncalled for effort spent, taking into account the years that this case may drag on for. The time and effort, which could be better utilised by a person of his experience and stature, for him and his lifes work, will be wasted in proving himself “not guilty” just because someone alleged something. Who takes responsibility to pay the damages, if he is proven not guilty? What if all this is a conspiracy based on some revengeful motivation? Will our courts hold media guilty too in that case? Are we not giving too much power to anyone who can come up with an Alleged charge? Pathetic lack of control on dissemination of information into the public domain, lack of sensible rules with respect to procedures in handling such a charge and most importantly allowing Media to go virtually Unpunished even when their virtual conviction in the public domain is later proven wrong / baseless / a conspiracy / premeditated / motivated by political or personal or organisational gain, are becoming poisonous factors in our country!! I strongly believe that the whole Legal, Police, Media and Governmental systems in place should play a role that is not just judgemental & executional. These systems should foster constructive and civil behaviours among the citizens, groups and organisations for the larger good of everyone and the nation. It is our responsibility as citizens to promote improvements in how things are handled so that the whole nation does not have to live under terror, mistrust, fear, ‘reduced’ standards of perceived civil / human values. Disclaimer: These thoughts are my general responses on way things work in India. Although the particular case in question here has not been exhaustively researched by me, numerous similar past events from various sectors of the country, of defamation and their repercussions have led me to form the above mentioned opinion which is entirely my personal. What I have said above is not in any way in-support or against any person /any organisation / institution / any political party /the country and its people. My views are my personal observations based on what I gather from public media that is available to all and I am exercising my fundamental right of free speech as a citizen of India. I am from the public domain and in no way professionally connected with any legal, governmental, media and statutory Bodies /Organisations /Institutions within India or any other country.
