Dear Mr. Bodden: Under the California Whistleblower Protection Act, found at Government Code section 8547 et seq., the California State Auditors Office (office) is only authorized to investigate allegations of improper governmental activities by state agencies and employees. We, therefore, lack the authority to investigate allegations of improper activities by local government agencies, such as the Imperial County Health Department. However, if you are interested in having the State Auditor conduct an audit of the Imperial County Health Department, you will need to contact one of your representatives in the State Legislature. Any member of the Legislature can request the State Auditor to conduct an audit using two venues--through a request to the Joint Legislative Audit Committee (JLAC), a 14-member committee comprised of seven Senators and Seven Assembly members, or through legislation. If an audit is approved, it becomes a mandate for our office. If you believe that your concerns may be addressed by an audit, you can contact your representatives in the California Assembly and Senate, as they can ask JLAC to authorize an audit that focuses on the issues that concern you.
