Does the Supreme Court have any authority to determine what should be the qualification of the representatives of the people and what should be the procedure for election? Its clear violation of the basic structure of the Constitution inasmuch as it violates the concept of separation of power. As per our Constitution, sovereignty vests on the people of India. Its on the people whom they choose as their representative and in what manner. Only the Parliament can make law in this regard, not any Court. The Courts should look at the number of pending cases and try to dispose of the same at the earliest instead of wasting their time in matters which the Parliament should take up, as the sovereign law-making body.
