FCR - Need for Reformation The Federally Administered Tribal Areas (FATA) the region bordering Afghanistan consists of seven agencies (North Waziristan, South Waziristan, Kurram, Mohmand, Bajaur, Khyber and Orakzai) and six FR regions (FR Peshawar, FR Lakki, FR Kohat, FR D.I Khan, FR Tank, FR Bannu). People are tried and prosecuted here under the British era Frontier Crimes Regulation (FCR) promulgated in 1901. It is widely termed as inhumane and set of black laws imposed on people of FATA. Prominent thinkers, jurists and civil society activists seek its reformation and demand basic fundamental rights given to the people of FATA, jurisdiction of Supreme Court and High Court shall be extended to FATA, local bodies system to be introduced and FATA members of parliament shall be given the right to legislate. Some political freedom is provided in 2011 after Pakistan people’s party (PPP) led government amended FCR and introduced political parties act to the region. Local say that all powers (executive, judicial and political) are vested in one person, the political agent. Maliks (local elders) decide their fate rather than modern day defined legal state apparatus. Journalists are also tied to FCR and cannot report freely, says tribal journalist Gul Muhammad Khan. FATA secretariat founded in 2002 could not bring fruitful results. Meanwhile, there are some Maliks who still consider FCR a way forward.
