FOR AND ON THE PUBLIC RECORD: SEPTEMBER 29, 2013 I, SAYYID ABDULLAH SERIF DO HEREBY SERVE THIS In The Name of God, the Creator, the Most Merciful Notice of A Sovereign Muslim a Blessed Living Sentient Flesh and Blood Soul Servant of GOD All GOD-Given Natural and Inalienable Rights Reserved (Without Prejudice) under the Command of Imam Mahdi Hujjatullah(a.s) the Awaited Saviour, This is my Truth and Law: 1 – Whereas Canada is a nation founded upon the belief in the principles of the Supremacy of GOD and the rule of law, and, 2 – Whereas GOD is the Highest Authority and GOD’s Law is Supreme, and, 3 – Whereas the number two position in that hierarchy is not claimed by anyone, and, 4 – Whereas Canada is a Common Law Jurisdiction, and, 5 -Whereas Her Majesty Queen Elizabeth II is the Queen of Canada, and, 6 – Whereas Her Majesty Queen Elizabeth II is the Queen of Canada and gave Oath to GOD, witnessed in the Abbey Church of St. Peter, Westminster, the second day of June, 1953 , and, 7 – Whereas Her Majesty Queen Elizabeth II the Queen of Canada is bound by that Oath to GOD, and, 8 – Whereas Chapter 22 Of Lawful Oaths and Vows of the Westminster Confession of Faith of 1646 describes Lawful Oaths and Vows, and, 9 – Whereas Her Majesty Queen Elizabeth II the Queen of Canada is bound by Oath to GOD to maintain to the utmost the Laws of GOD, and, 10 – Whereas the governments of this nation seem to rely on deception to gain the power to govern, and, 11 – Whereas I am desirous of living my life as a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD, and, 12 – Whereas I a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD have also given an Oath to GOD, and, 13 – Whereas I a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD am bound by that Oath, in full Submission and Duty to GOD Alone, and, 14 – Whereas the only power able to claim any authority over a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD is GOD, The Holy Prophet Mohammed(a.s), Imam Ali(a.s),the Holy Imams(a.s.a) and Imam Mahdi Hujjatullah(a.s), and, 15 – Whereas neither the government, nor its agents nor its representatives or employees are GOD or above GOD, and, 16 – Whereas by lawfully claiming the number two position in the above mentioned hierarchy, I occupy a position above all governments and their agents and employees and representatives, and, 17 – Be it known to any and all that, I a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD do hereby Lawfully claim the status of a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD, and, a) any human being or other de facto legal fictions who wishes to claim any authority over me must first prove they exist above GOD, and, b) they are GOD, and, c) they are between me and GOD, and, d) they have a document upon the face of which can be found the verifiable signature of GOD, and, Failure to first do one of the above mentioned things means all claims to authority are abandoned and are unlawful. Attempting to exercise any authority over me without first fulfilling one of the four above mentioned requirements is an unlawful act of fraud and/or extortion. FOR AND ON THE PUBLIC RECORD: In The Name of God, the Creator, the Most Merciful NOTICE OF COMMON LAW JURISDICTION AND UNDERSTANDING AND INTENT AND CLAIM OF RIGHT 1. Whereas it is my understanding Canada is a Common Law Jurisdiction, and,2. Whereas it is my understanding equality before the Law is paramount and mandatory, and, 3. Whereas it is my understanding that article 39 of the Magna Carta states; No freeman shall be arrested or imprisoned or deprived of his freehold or outlawed or banished or in any way ruined, nor will we take or order action against him, except by the lawful judgment of his equals and according to the law of the land, and, 4. Whereas it is my understanding a statute is defined as a legislated rule of society which has been given the force of law, and, 5. Whereas it is my understanding a society is defined as a number of people joined by mutual consent to deliberate, determine and act for a common goal, and, 6. Whereas it is my understanding that for something to exist legally it must have a name, and, 7. Whereas it is my understanding the only form of government recognized as lawful in Canada is a representative one, and, 8. Whereas it is my understanding representation requires mutual consent, and, 9. Whereas it is my understanding that in the absence of mutual consent neither representation nor governance can exist, and, 10. Whereas it is my understanding all Acts are statutes restricted in scope and applicability by the Constitution Act, and, 11. Whereas it is my understanding people in Canada have a right to revoke or deny consent to be represented and thus governed, and, 12. Whereas it is my understanding if anyone does revoke or deny consent they exist free of government control and statutory restraints, and, 13. Whereas it is my understanding that a claim of right establishes a lawful excuse and that this factual truth is expressed in Section 39 of the Criminal Code of Canada, and, 14. Whereas it is my understanding that Forcible Detainer is defined in the Criminal Code of Canada, and, 15. Whereas it is my understanding that Section 72 (2) of the Criminal Code of Canada states ; A person commits Forcible Detainer ; When, being in actual possession of real property without colour of right, he detains it in a manner that is likely to cause a breach Of the peace, against a person who is entitled by law to possession of it, and, 16. Whereas it is my understanding that Black’ s Law Dictionary 2nd Edition defines “License” as; ” a permission, accorded by a competent authority, conferring the right to do some act which without such authorisation would be illegal, or would be a trespass or a tort. “,and, 17. Whereas it is my understanding that Black’ s Law Dictionary 2nd Edition defines ” Competent Authority ” as applied to courts and public officers, this term imports jurisdiction and due legal authority to deal with the particular matter in question.”, and, a) Whereas it is my understanding sui juris means in ones`s own right, and, b) Whereas it is my understanding one who is not sui juris cannot claim jurisdiction or authority over one who is sui juris, and, 18. Whereas it is my understanding that a Security Guard is defined by The Private Investigators and Security Guard Act, and, 19. Whereas it is my understanding that a Corporation is a legal fiction, which lacks a soul and is not thus blessed, and, 20. Whereas it is my understanding that a Security Guard as defined in the Private Security and Investigative Services Act, 2005 and is clearly not a Peace Officer nor is a Security Guard an agent of the State, nor does a Security Guard have the authority to assume the duties of a Peace Officer, and, 21. Whereas it is my understanding that a Security Guard, Private Security Guard or Night Watchman is an employee, representative and agent of a legal fiction, and, 22. Whereas it is my understanding that all corporations are De Facto and not De Jure, and, 23. Whereas it is my understanding that Black’ s Law Dictionary 2nd Edition defines ” De Facto ” 24. Whereas it is my understanding Private Security Guards, Security Guards, Nightwatchmen, agents, or other representatives are employed and hired by De facto corporations and are not peace officers and are acting ultra vires, that is; beyond their powers, and, 25. Whereas it is my understanding that Forcible Detainer, Kidnapping and Abduction are crimes according to the Criminal Code of Canada, and, 26. Whereas it is my understanding that the Canadian Charter of Rights and Freedoms guarantees mobility rights, and, 27. Whereas it is my understanding that the Canadian Charter of Rights and Freedoms guarantees, freedom of expression, privacy and protection against arbitrary search and seizure, and, 28. Whereas it is my understanding that Admiralty Law / Maritime Law concerns activities which occur at sea, and, 29. Whereas it is my understanding that Commercial Law/Mercantile Law concerns the practices of traders, and, 30. Whereas it is my understanding that neither Maritime Law nor Commercial Law are the Law of the Land, and, 31. Whereas it is my understanding that Treason is a crime, and,a) Whereas it is my understanding that I am not obliged to obey any agreements made by traitors to Canada with any foreign jurisdiction, and,b) Whereas it is my understanding I have the right and duty to GOD to repel, harass and resist all foreign troops and occupiers, and, 32. Whereas as I am a Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD who operates with full responsibility and not a child, I do not see the need to ask permission to engage in Lawful and peaceful activities, especially from those who claim limited liability, and, 33. Whereas it is my understanding a by-law is defined as a rule of a corporation, and,Whereas it is my understanding corporations are legal fictions and require contracts in order to claim authority or control over other parties, and, 34. Whereas it is my understanding legal fictions lack a soul and cannot exert any control over those who are thus blessed and operate with respect to that knowledge as only a fool would allow soulless fictions to dictate ones actions, and, 35. Whereas it is my understanding Security Guards, Police, and Peace officers have a duty to distinguish between statutes, Law and bylaws and those who attempt to enforce statutes, laws and bylaws against a Blessed Soul Servant of God, are in fact breaking the Law, and, 36. Whereas I have the power to refuse intercourse or interaction with Security Guards, Police and Peace officers who have not observed me breach the peace, and, 37. Whereas it is my understanding that the Common Law Right to travel on the roads, highways and streets without license is Lawful and still exists, and,a) Whereas it is my understanding that Black`s Law Dictionary defines a Coach as; a Covered Carriage distinguishable from other vehicles, and, b) Whereas it is my understanding that such a Carriage is used for travel on the land, and, c) Whereas it is my understanding that a Coach may be rented, hired or purchased to facilitate travel on the land, and, d) Whereas it is my understanding that Highway Robbery and Banditry are crimes, and,e) Whereas use of a Service for which one has paid is not Tacit Consent, nor is it giving Consent to the abrogation of one`s GOD-Given, Natural and Inalienable Rights, and, 38. Whereas it is my understanding that I have the right to refuse to interact or cooperate with grossly negligent Security Guards, Police and Peace officers, and, a) Whereas it is my understanding that a security guard is not a peace officer and, b) Whereas it is my understanding that a security guard is not an agent of the state, and, c) Whereas it is my understanding that a security guard and police officers are employees of a de facto corporations, and, 39. Whereas it is my understanding that if Security Guards, Police and Peace officers are not providing a service they have no reason to stop anyone and if identification is not valuable they have no need to ask for it, and, 40. Whereas it is my understanding that I have the right to refuse to interact or cooperate with criminals or de facto corporate, government principals, employees, agents or representatives and, 41. Whereas it is my understanding that if I have the power to elect a representative and empower them to appoint peace officers then I also have the power to appoint directly, and, 42. Whereas it is my understanding that if I have the power to appoint directly or by proxy I must have the power to fulfill those duties myself, and, 43. Whereas it is my understanding that the Law provides remedy at all times, even against rogue or negligent peace officers and de facto government agents apparently hijacked by soulless corporate interests, and, 44. Whereas I do desire to be blessed and to be a peace maker in the service of GOD, and, 45. Whereas it is my understanding that the person and the human being to which it is associated are two very separate and different things and, 46. Whereas it is my understanding that if I do not exist in association with a person I cannot be Lawfully governed by the people playing roles in government, and, 47. Whereas it is my understanding that I am not obliged to obey the orders of anyone claiming authority or those acting on behalf of such an entity or entities, as no one who does make preposterous claims that abandon and erode the concept of equality has any authority over me, and, 48. I, a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD hereby notify and serve notice to all in the Universe and all Universes, Realms known and unknown and other interested parties under the Rulership, Dominion and Kingdom of GOD, The Almighty Creator, that I have revoked my consent to be governed by fictitious corporate entities and all foreign jurisdictions and state clearly, specifically and duly declare my intention to Peacefully and Lawfully exist free of all statutory obligations, restrictions and maintain all rights at Law to trade, exchange or barter and exist without deceptive governance and to do so without limitations, restrictions or regulations created by others and without my consent.Furthermore, I claim that that my Home is my Castle. Furthermore, I claim that the Land called and named Canada is in fact GOD’s Land. Furthermore, I claim that the Land called and named Canada was created by GOD and was in existence before being so called and named. Furthermore, I claim that Canada is my Home and Castle and that I have the Right to Defend my Home and Castle by any means necessary and to stand my ground against all manner of trespass, assault and acts of aggression.Furthermore, I claim that all of my offspring and progeny are my Natural GOD-given property that I will defend by any means necessary and to stand my ground against all manner of trespass, assault and acts of aggression.Furthermore, I claim that these actions are not outside my community standards and will in fact support said community in our desire for truth and maximum freedom. Furthermore, I claim the right to engage in these actions and further claim that all property held by me is held under a claim of right. Furthermore, I claim that anyone who interferes with my Lawful activities after having been served notice of this claim and who fails to properly dispute or make lawful counterclaim is breaking the law, cannot claim good faith or colour of right and that such transgressions will be dealt with in a properly convened court de jure. Furthermore, I claim that courts in Canada are De facto and bound by the Law and are in fact in the profitable business of conducting, witnessing and facilitating transactions of security interests and I further claim they require the consent of both parties prior to providing any such services. Furthermore, I do hereby deny consent to any transaction of a security interest issuing under any Act for as herein stated as a Sovereign Muslim, a Blessed Living Sentient Flesh and Blood Soul Servant of GOD I am not subject to any Act. Furthermore, I claim my FEE SCHEDULE for any transgressions by any De facto Corporation, security guards, police and peace officers, government principals, employees, agents or justice system participants is FIVE THOUSAND DOLLARS PER HOUR if being questioned, interrogated or in any way detained, harassed or otherwise regulated and TWENTY THOUSAND DOLLARS PER HOUR or portion thereof if I am degraded, threatened, handcuffed, assaulted, transported, abducted, incarcerated or subjected to any adjudication process without my express written and notarised consent.Furthermore, I claim the right to secure payment of the aforementioned FEE SCHEDULE against any transgressors who by their actions or omissions harm me or my interests, directly or by proxy in any way. Furthermore, I claim the right to convene a proper court De jure in order to address any potentially criminal actions of any security guards, police, peace officers, government principals or agents or justice system participants who having been served notice of this claim fail to dispute or discuss or make lawful counterclaim and then interfere by act or omission with the Lawful exercise of properly claimed and establishedrights and freedoms.Furthermore, I claim the law of agent and principal applies and that service upon one is service upon both.Furthermore, I claim the right to deal with any counterclaims or disputes publicly and in an open forum using discussion and negotiation and to capture on video or other audio visual devices said discussion and negotiation for whatever lawful purpose as I see fit. Affected parties wishing to dispute the claims made herein or make their own counterclaims must respond appropriately point by point within Forty (40) days of service of notice of this action. Responses must be under Oath or Attestation, upon full commercial liability and penalty of perjury and registered in the Notary Office provided no later than 40 days from the date of original service as attested to by way of service. Failure to register a dispute against the claims made herein will result in an automatic default judgment and permanent and irrevocable estoppel by acquiescence barring the bringing of charges under any statute or Act against myself a Blessed Soul Servant of GOD, for exercising these lawful and properly established rights, freedoms and duties.
