For Immediate Release Thurs Aug 14, 2014 Appeal Court Rules Derivatives Now Legal Victoria, B.C.: This morning Owen Smith was handed down a victory in a 2-1 split decision by the BC Court of Appeal, which has given the federal government one year to change the regulations to allow patients to buy cannabis extracts. With a split decision the government is able to appeal to the Supreme Court of Canada. For now, this is a huge victory for patients across the country who can now make cannabis derivatives without fear of criminal charges. After being arrested in an apartment building making cookies for the Victoria Cannabis Buyers Club in Dec 2009, Owen launched a constitutional challenge. He was charged with possession of Tetrahydrocannabinol, THC, for the purposes of trafficking. Under the former rules, the Marihuana Medical Access Regulations, and the new ones, the Marijuana for Medical Purposes Regulations, patients are legally only allowed to use ‘dried marijuana’. Until today. His message to Canadians is simple. “I want sick people to know that there are people in society who they may not know personally, but who care about them enough to put their freedoms on the line.” A press conference is being held at 1pm at 826 Johnson St, the home of the Victoria Cannabis Buyers Club, to explain more about the case, decision and future of medical cannabis in Canada. There are some questions about the impact of this decision given the changes in regulations. As lawyer Kirk Tousaw states, “The court disagreed with the remedy imposed by the trial judge and modified that remedy to simply strike the dried marijuana provisions in the regulatory scheme and gave Parliament a one year to respond.
