[From Usab Pandey] Good news that finally the Government has accepted all the demands of the students. However, the points you have highlighted above need further clarification before it is accepted that the issues are resolved amicably. I have the following points to raise as our students have fought for justice for last three days putting their lives at stake and it is the duty of every citizen of Sikkim to look at these points so that such incidents do not occur in future again: 1. Suspension of SP,East after the enquiry panel submits its report is just an eye-wash. He must be put under suspension with immediate effect. Simply transferring him to another wing or section does not make any sense. He being a senior IPS officer there is every possibility that he will influence the enquiry. To ensure an independent, impartial and unbiased enquiry and in the interest of justice he must be placed under suspension immediately and then hold the enquiry. After the enquiry is completed it is not suspension but concrete action should be initiated against the guilty officers. This is the normal administrative procedure. 2. Only an enquiry panel headed by the sitting Judge of the High Court can be impartial and independent. How can a nominated IAS officer (Secretary, LRDM) hold an impartial and unbiased enquiry of a case involving the two senior members of the All India Service (DC, East who is an IAS officer and SP.East who is an IPS officer)? This seems to be another eye wash. 3. What is the locus standi of the meeting held today? Who called this meeting? Was it a cabinet meeting chaired by the Chief Minister? If it was indeed a Cabinet meeting held in absentia of the HCM it should be clearly mentioned to the public. In what capacity did Mr. K.T. Gyaltsen attend today’s meeting? He is not the member of the cabinet nor an MLA nor a part of the government either! The matter was purely an affair of the HRDD and Home Department and hence the HRDD Minister presiding it was understandable. What were the other Ministers doing there? Seven Cabinet Ministers of whom some happen to be accomplished lawyers and some student representatives. Come on! Please spare our kids. They know nothing about the legal aspects of these points.
