Generally, pedestrians have the right-of-way. However, the requisite is that when there is no sidewalk pedestrians must travel against the flow of traffic--single file--in order to see whats coming at them. Further, when there is no sidewalk, pedestrians have the right to road share the curb lane--no farther than--into the passenger side of a motor vehicle. Additionally, it is advisable that pedestrians have safety gear (i.e., flashers, flashlight, vest, and so forth) in darkness which would give some assurance that motorists can see them.
