HERE IS THE VILLAGE ORD. REGULATING YARD SALES/ GARAGE SALES IN THE VILLAGE OF ATTICA. IT SI ORD 2007-13 AND IS AS FOLLOWS: REGULATION OF YARD SALES/GARAGE SALES Definitions "Garage Sale” shall mean all general sales, open to the public, conducted from or on a residential premises or residential real estate, for the purpose of disposing of personal property, including, but not limited to, all sales commonly referred to as "garage", "lawn", "yard", "attic", "porch", "room", "backyard", "patio", "flea market", or "rummage" sale. "Personal Property" shall mean property which is owned, utilized and maintained by an individual or members of his or her residence and which has been acquired in the normal course of living in or maintaining a residence. “Residential premises” shall mean any single or multi-family dwelling and the entire parcel of property upon which the dwelling is located, regardless of its zoning classification. “Residential real estate” shall mean that property which contains at least one unit of housing, regardless of its zoning classification. Limitation on number of garage sales No person shall hold or permit to be held more than three garage sales per calendar year of items of personal property on residential real estate owned by or in the possession of such person. For the purposes of this section, “residential real estate” shall mean that property which contains at least one unit of housing, regardless of its zoning classification. The specific intent of this section is to limit the combined number of garage sales, as defined in this section, to a maximum number of three sales per year per address of residential real estate located within the Village, each sale lasting not more than three consecutive days. Sales shall not be extended, nor shall additional sales be permitted, because of inclement weather. It shall be no defense to a violation of this ordinance that the premises or real estate is not zoned “residential” or other similar classification. Signage Unless located upon the real estate where any sale pursuant to this chapter is being conducted, all signs shall be located on private residential property only and with the consent of the property owner and may not be attached to any utility pole or located in any street right-of-way. Signs located on another’s private property shall not exceed the dimensions of two feet by one foot. No sign shall obstruct visibility to individuals using the streets, alleys and sidewalks in a manner which would jeopardize the health and safety of such individuals. All signs shall be removed as soon as practical after the sale is terminated pursuant to this ordinance. Permits/Notification No permit shall be required to conduct a garage sale. The owner or occupant of the residential premises upon which a garage sale is to be conducted shall notify the Village Administrator in writing of the address, date, time and duration of the garage sale at least seven (7) days prior to the date of sale. Penalty Whoever violates or fails to comply with any of the provisions of this ordinance shall be fined not more than fifty dollars ($50.00) per offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
