HEY CITY COUNCIL WHO IS KNOCKING ON OUR DOORS & AND ARE THEY REGISTERED PLUMBERS ANOTHER LETTER TO CITY LEADERS, WHILE EXPECTING THE SAME! NOTHING December 8, 2014 Members of City Council David P. Andrews, Esq., City Solicitor Renee Daly, Director-City’s DCED With the ongoing Inner City Sewer upgrade continuing into more City neighborhoods, I personally had my first contact with, I am assuming, a worker/representative of the firm contracted for work in and around my Corinne Street residence on Wednesday, December 3, 2014. A gentleman in working clothes and carrying a “pipe wrench” came to my door seeking access to my cellar sewer, as described by him “cap”. He explained it was to determine the location of a lateral. Having had no prior notice from the City or EADS of this unannounced visit and the request to enter into my dwelling, I declined his access. He ask when it might be convenient for him to come back. My initial response was that he could come back on Monday, December 8, 2014 at 9:00 a.m., the same date of this communication. Having given this further thought, and again without any official notice from the City, and explaining what this access would result in, I am further declining until such is received. While this gentleman was polite and courteous, there was no attempt to produce any visual identification as to his firm or himself. Further it is my belief, and based on the Codified Ordinances of the City of Johnstown 1448.01 LICENSE AND CERTIFICATE REQUIRED. No person, other than a registered master plumber, shall carry on or engage in the business of plumbing or house drainage in the City, and no person shall expose a sign of plumbing or house drainage, or any advertisement pertaining thereto, unless he or she has first obtained a license and certificate of competency therefor and has been registered by the Department of Community and Economic Development. (Ord. 4397. Passed 9-10-86.) That any parties desiring access to my dwelling for the purpose of viewing, testing and determine the location or existing conditions, are required to by a plumbers registered with the City of Johnstown. Thru a Right to Know Request filed on March 7, 2014, and appealed to the Office of Open records, access was granted to City records of Registered Plumbers for the years 2013 and 2014, with many of the local plumbers listed. Since that time I have additional concerns that inner city sewer work is being done by persons not duly registered in the City of Johnstown. All are reminded that the Codified Ordinances of the City of Johnstown in 1448.02 REGISTRATION OF PERSONS HOLDING LICENSES OR CERTIFICATES FROM OTHER JURISDICTIONS. States: Any person holding a license or certificate of competency granted by any first, second or third class city of the Commonwealth, to engage in or work at the business of plumbing and drainage work, who desires to do plumbing or drainage work in the City, shall, without examination, be registered before entering upon such work, upon the payment of a fee as set forth in Section 1422.04(b), which fee shall be paid into the City Treasury. The registration shall consist of recording such persons name and address only. However, such registration shall be restricted and limited to such plumbing and drainage work as such person shall have contracted for at the time of registry. On the completion of such contract, the registration of such person shall be null and void and no further permit shall be issued until he or she has first registered his or her name and address, as provide above in this section. (Ord. 20. Passed 3-17-14.) As a legally adopted Ordinance of the City of Johnstown, enforcement is mandated, and any non-compliance which may be as a result of the contracted services of The EADS” Group or the designated City Engineer is not acceptable or a legal action. City Council and the City Solicitor are obligated to insure that the residents of the City of Johnstown are given assurances and protection that only the properly qualified parties are preforming work on City inner city sewer project. This in addition to demanding and requiring that any and all employees and supervisor personnel from all business under contract with the City of Johnstown have City issued photo identifications on their person when attempting to visit or enter into homes and businesses. Unless and until these City Ordinance mandates are complied with, no access will be granted to my residence located at 360 Corinne Street. Should the City be of the opinion that an action be filed with the Cambria County Court of Common Pleas in this matter, I would welcome the opportunity have the Court, at the same time adjudicate the City’s non-compliance with those Codified Ordinances mandates as cited above.
