Hey all you WUW fans..... Im not sure if this would stand up in court or if anyone has thought about this angle. When you get a photo radar ticket in the mail as I did a few days ago I see that it was from the 10th of August. It was processed on the 15th and mailed on the 18th with me receiving it on the 20. A full 10 days after the fact. Here is what I am thinking. Every citizen has the right to a fair trial. If I was to go back to the place where I got the ticket 10 days after the fact, it is quite possible that the signage and conditions in the apparent construction zone would have changed. If I had gotten a ticket from a police officer i would have the ability, right then and there to document the scene of the offence in order that I would have evidence to produce at my hearing. I have the right to enter that evidence as part of my defence. If the offence happens on the 10th and I get the actual ticket on the 20th I do not have the same ability to document the same evidence thus giving the court an unfair advantage in the case. This is NOT conducive to me getting fair trial since I don;t have the same ability to collect evidence in my defence. Thoughts anyone?
