I am sending this message with urgency in regards to my brother and his 3 small children. My family has been trying to contact every news station since all this started and with no luck now it is time to make this known to the public and world. First, my brother Nicholas Libertiny has had full custody of his three children all their life and has not had any support from the biological mother what-so-ever. Since 2010 the final decree gave my brother full custody, now last week the non-custodial parent had her attorney change that by getting a court date without my brother’s awareness. Now that placed my brother in default since his hired attorney did not inform him there was a court date the biological mother was given all my brother’s rights. In addition, my brother was ordered to pay close to $400.00 The problem with this is that ever since 2010 the agreement to take her off child support and zero out arrears was in the agreement that she would provide support and be involved in the children’s lives without drama. Now approximately 30-45 days ago she filed a Motion to Modify the Parent Child Relationship and the citation stated my brother was being sued and my brother would have to respond within 20 days. 3 days before the end of that period my brother hired attorney Laura Win-get Hernandez and she never reported to the court that she was representing my brother. Come to find out, the biological mother’s attorney Ms. Bannen was Laura Win-get Hernandez’ mentor. So bottom line is my brother’s attorney threw him under the bus on this case and on Monday September 30,2013 both attorneys had a conversation on their personal time and Laura was acting like she didn’t. the only way we found out was by Laura’s assistant Alexa. We have collected so much evidence against Laura and the biological mother to prove wrong doing and criminal acts but we get no help anywhere. Her name is Ashley Nichloe Garcia and her husband’s name is Gerardo J Garcia I believe. Like I was saying earlier Ashley has not been in these children’s lives at all, the youngest was taken from her at the hospital and given to my mom since she had CPS cases and was found unfit. Over this weekend Ashley took the kids for the weekend with a falsified court document that my brother did not agree upon and all three kids came back with bruises. My brother went to the police station and made a report of child abuse and one officer said it wasn’t abuse to lock a kid in the closet plus when the kids are over there visiting Gerardo has every right to discipline my brother’s children. The children told us how Ashley and Gerardo lock the kids in the closet when they don’t listen and they got abused when they stayed up all night and didn’t want get up for school Monday morning due to her not putting the children to sleep at an appropriate time. Either way, Ashley nor Gerardo have no right to abuse these children and we need to eliminate all forms of contact immediately for the sake of the children. My brother is willing to talk and is currently in court today October 8th, 2013 in room 109 at Bexar County Court and the time for court is 10:00am. In addition to all this info Ashley provided the address of a vacant apartment to the court with no contact number and the order that was granted did not have the correct spelling of the children’s names. You would think a parent who signed for a name change would know the correct spelling of the kids names!!!!!!!!!!!!!!!!!!!!!! There is so much more to this case please call or go to the court this has been my week... fighting for the lives of three children who should not be subjected to this and the court should protect our innocent Update----- the order was thrown out today and the final decree stands The babies are home SAFE
