I am very busy and had placed my account on deactivate to get some stuff done. However, I cannot let this ethics ruling against Gessler go unanswered. Today the District Court ruled, in Pages 6 - 7 of its opinion, that because Gessler knew of the facts and conduct at issue and that this was an administrative (and not a criminal) hearing, there was no requirement to tell him the specific elements of what he was charged with. My friends, this means the IEC can haul any politician in front of it and say we believe you broke the law, but we arent going to tell you how, as we will figure that out after your trial. It makes a mockery of due process, and it is exactly why we should hope the Democrats and the Republicans can work together to remedy this travesty with a statutory solution as soon as possible.
