Lawyers Weekly Staff August 21, 2014 On Nov. 6, 2010, the plaintiffs were stopped in traffic when the defendant, who was operating her mother’s vehicle on a learner’s permit, slammed into the rear of their vehicle. One plaintiff suffered a disc protrusion at L4-L5; the other suffered a shoulder strain. Plaintiffs’ counsel made multiple attempts to contact the national insurance carrier, which eventually valued the claims at $4,000 each. After plaintiffs’ counsel sent Chapter 93A and 176D demands, the insurer increased one of the offers by $1,000, for a combined $9,000. After full discovery and additional 176D demands, the offers were increased to a combined $50,211. Further 176D demands were made citing Martinez Rivera, et al. v. Commerce Insurance Company, et al., and after further negotiations, the case settled on the eve of trial for claims of $20,000 and $40,000.
