INSTEAD OF UNDERPINNING DEMOCRACY, human-rights laws undermine it. Far from constraining the state to make democracy possible, human-rights laws seek to transfer issues from the political sphere, where they are subject to democratic accountability, to a legal sphere that is beyond democratic accountability. The key problem with human rights law is that it outsources to the judiciary what should be political decisions taken by Parliament. The human rights lobby fundamentally distrusts the democratic process which empowers the people.
