SCA upholds Mdluli ruling Stephen Grootes | Yesterday, 17:08 JOHANNESBURG – The National Prosecuting Authority (NPA) must re–examine its decision to withdraw fraud and corruption charges against former Crime Intelligence chief Richard Mdluli, the Supreme Court of Appeal (SCA) ruled on Thursday. The Bloemfontein court upheld an earlier ruling to reinstate charges against the controversial cop. Mdluli was arrested in connection with the 1999 murder of Vosloorus man Oupa Ramogibe. He also allegedly employed family and friends as Crime Intelligence operatives. The NPA previously insisted on withdrawing the charges, despite the fact that former prosecutor Glynnis Breytenbach wanted to continue with the case. The senior prosecutor was suspended and claimed she was sidelined for pursuing the matter. Mdluli had also written to President Jacob Zuma promising to help him politically, amid claims he was tapping the phones of the presidents political opponents. Judges say the decision to withdraw the charges was illegal. They also say the head of the NPAs Specialised Commercial Crimes Unit, Advocate Lawrence Mrwebi, clearly lied about how he took the decision to withdraw the charges. Freedom Under Law (Ful) chairperson Judge Johann Kriegler was responsible for challenging the prosecuting bodys decision. He says Thursdays ruling is serious as the court made a credibility finding against a person in the second level of seniority within the NPA. Mdluli could now face charges again in the near future.
