In a ruling issued yesterday on Deepwater Horizon economic settlements, Judge Carl Barbier held that BP cannot recoup settlement money paid to business claimants, calling the grounds for BPs appeal classic hair-splitting. From the article: BP told claimants, “If you sign this release, that’s it, it’s over for you. It doesn’t matter if the law changes or not, or if the interpretation of the settlement terms changes for better or worse,” Barbier said. “I don’t know how you get around it.” BP had filed suit for restitution after the 5th Circuit ruled that the method used for calculating payments under the settlement was flawed.
