In response to recent Elmo-complaints in Times Square, Council Member Andy King has introduced a city law that would forbid wearing An article of clothing, accessory, mask, paint, or other object that ... causes a person to resemble a character rather than his or her own personal identity while performing in NYC. As written, the proposal would outlaw not only vast swathes of political speech, but also Halloween Trick-or-Treating. The question is raised: does Andy King not know how to write a law, or does he actually believe forbidding all costumed performances in NYC to be good policy?
