It appears the Prosecution intends to use the Stanbic Bank Officials arrested with Kessben as Prosecution witnesses. Once the Charge relating to the Conspiracy was withdrawn,it is clear that the Prosecution may be considering rather using the Stanbic officials as witnesses against the accused person. Remember that the Conspiracy requires more than one mindbreathing together. The Stanbic Officials may be saying that based on the alleged false representation or forgery,they made those transfers and that at that time they had reasonable cause to believe that the representations were accurate. Evidence in proof of a case normally is either direct or circumstantial or both. The proof of knowledge or mens rea is not capable of direct proof but same may be inferred from established facts as stated in section 18 (2) of NRCD 323. #INTERESTING TIMES AHEAD #INNOCENT UNTIL PROVEN GUILTY
